I have voluntarily elected to participate in a SHiNE Dance Fitness™ Instructor Certification Training. I acknowledge that, as with other athletic activities, there are risks inherent in dance and fitness training including, without limitation, the risk of injury to bones, joints, tendons, ligaments, and muscles. If I experience an injury or have concerns about a possible injury, I should and will promptly consult a physician and notify my instructor.

By signing below, I assume the risk related to dance and or fitness training during a SHiNE Dance Fitness™ Certification Training class. I hereby release Kendall Nielson (Owner of SHiNE Dance Fitness, LLC) and other instructors that are teaching SHiNE Dance Fitness™ from, and hold harmless against, all claims (including claims of negligence), actions, damages, liabilities, and expenses (including reasonable attorneys’ fees) (collectively “Claims”) arising out of or resulting from the dance or fitness class and the use of the studio facility (including, without limitation, personal injury and the loss or destruction of personal injury and the loss or destruction of personal property).

Furthermore I agree and acknowledge that the SHiNE Dance Fitness™ Certification Training materials and all their contents, regardless of form, are the confidential trade secrets and exclusive property of SHiNE Dance Fitness™, and I shall maintain the confidentiality thereof. SHiNE Dance Fitness™ further retains all trademark, trade dress, copyright, trade secret, patent, and other intellectual property rights applicable to the materials including.

Portions of the Training may be digitally recorded for use in SHiNE™ promotional activities. By signing below, I hereby grant SHiNE Dance Fitness™ permission to the rights of my image, likeness and sound of my voice as recorded on audio or video without payment or any other consideration. I understand that my image may be edited, copied, exhibited, published or distributed and waive the right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of my image or recording in all media for exhibition, advertising, sale, and print media.
